1. Who you are contracting with
Your contract is with Resort Scenery Hospitality Ltd (NZBN 9429048817326), a New Zealand limited company trading as Resort Scenery at 31 Esplanade, St Clair, Dunedin 9012, Otago, New Zealand. These terms are governed by New Zealand law and the courts of New Zealand have jurisdiction. Nothing here limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply.
2. Bookings and rates
- A booking exists once we have confirmed it in writing, by email or letter, and taken the deposit.
- Rates are per room per night for two people sharing, in New Zealand dollars, and include GST at the rate in force.
- Rates move with the season. A rate is fixed for your booking once confirmed and is not increased afterwards.
- Breakfast in The Beacon Room is NZ$36 per person unless a package includes it.
- A third adult in a room built for one is NZ$62 per night. Cots are free.
- Maximum occupancy per room is stated on the rooms page and is a fire-safety limit rather than a preference.
3. Deposit, payment and cancellation
- A deposit of one night is taken at the time of booking.
- Cancellation more than 48 hours before arrival — the deposit is refunded in full to the card that paid it.
- Cancellation inside 48 hours, or a no-show — the deposit is retained. Nothing further is charged.
- Bookings of five rooms or more, and event bookings — 30 days’ notice, on terms set out in a separate agreement.
- The balance is payable on departure. We take Visa, Mastercard, American Express, EFTPOS and cash. Any card surcharge is displayed before you confirm.
- If a flight into Momona is cancelled or State Highway 1 is closed and you cannot reach us, the deposit is not retained.
4. Arrival and departure
- Check-in from 3pm; check-out by 11am. Reception is staffed twenty-four hours, so a late arrival is expected rather than a problem — tell us the flight and the room is held.
- Late checkout to 2pm is NZ$42 where available, and is included in the Taiaroa Suite rate.
- Luggage may be stored before check-in and after check-out at no charge.
- One car park per room is included in the rate. Spaces are not allocated to a particular room and are not held after 6pm on the day of arrival.
5. Packages
- Packages are subject to availability and cannot be combined with each other or with any other offer or corporate rate.
- A package price is for the whole package as described, not per night, unless it says per person per day.
- Unused parts of a package — a treatment not taken, a dinner not eaten — are not refundable and have no cash value.
- Dining credit is spendable in The Beacon Room and The Cargill Bar, is not exchangeable for cash, and expires on checkout.
- Gaming credit is loaded at reception at check-in, applies only in The Albion Room, requires photo identification and an age of 20 or over, is not transferable, cannot be exchanged for cash, and does not carry over to a later visit.
6. The Albion Room
- Entry is restricted to people aged 20 years and over under the Gambling Act 2003. Photo identification is checked on every visit without exception.
- All gaming takes place on these premises. There is no online play, no application to download, no account, and no part of this website on which anything can be staked.
- No credit is extended for gaming in any form. Gaming spend cannot be charged to a room account.
- Smart casual dress after 6pm. The duty manager’s decision on dress and on conduct is final.
- The room closes at 2.30am, seven days a week.
- We may refuse entry to, or remove, any person — in particular anyone subject to a self-exclusion order, anyone who appears intoxicated, and anyone who cannot produce identification.
- Our host responsibility policy forms part of these terms.
- The gaming room cannot be hired, booked out, or made part of an event or wedding contract.
7. House rules
- Smoking and vaping — not permitted anywhere indoors, under the Smokefree Environments and Regulated Products Act 1990. A cleaning charge of NZ$350 applies where a room has been smoked in.
- Quiet — 10pm to 7am on the bedroom levels and in the corridors.
- Animals — assistance dogs are welcome everywhere on the property. Other animals are not accommodated.
- Under-18s must be accompanied by an adult in the bathhouse, and nobody under 20 is admitted to the gaming room.
- The hot pool is 16 and over, which is a temperature rule rather than a licensing one.
- Damage — we may charge for damage beyond fair wear, at cost, with the invoice shown to you.
- Parties in bedrooms are not permitted. Gatherings belong in The Peninsula Room, which is what it is for.
8. Liability
- Property left in a room is left at your risk. The safe in the room is provided for valuables and the front desk will hold anything that does not fit in it.
- We are not liable for failures caused by matters outside our reasonable control: road closure, storm, earthquake, flood, power failure or a regulatory direction.
- Where a service is not provided as described and the fault is ours, the remedy is a refund of the amount paid for that service.
- The beach, the sea wall and the Esplanade are public land maintained by the city council and are not part of the hotel. Swimming at St Clair Beach is at your own risk and is patrolled only in summer, between the flags.
- Nothing in this clause limits liability for death or personal injury caused by our negligence, or any liability that cannot be excluded by New Zealand law.
9. Website
The text and images on resortscenery.com belong to Resort Scenery Hospitality Ltd and may not be reproduced without permission. We take care to keep prices and hours accurate but do not warrant that every page is current at every moment; the rate confirmed to you in writing is the rate that binds us.
10. Complaints
Ask for the duty manager while you are still here — almost everything is fixable on the day and almost nothing is fixable a fortnight later. Afterwards, write to [email protected], which reaches the general manager rather than the front desk.
